Scooter Accident Injury Attorneys in Gastonia, NC

If you were injured in a moped or scooter accident near Gastonia, NC, our firm stands ready to help you collect maximum payment for your scooter/moped damage and for your injuries and suffering. Insurance adjusters who represent the at-fault driver WILL seek to minimize your claim payments. Former insurance adjuster Carl Nagle can level the playing field, and help you investigate your crash, build a winning case, and collect maximum payment for your losses.

Mopeds and scooters offer a practical alternative to cars, especially in busy urban environments where traffic can be overwhelming. However, many cities lack the infrastructure necessary to accommodate the diverse range of vehicles sharing our roads in The Tar Heel State. Although the number of scooter accidents has been increasing with the rise of shared-use programs across many cities, moped accidents still occur much more frequently.

According to 2019 crash statistics from the Gastonia Department of Transportation (NCDOT), there were:
867 moped crashes - resulting in 28 fatalities
59 motor scooter (or motorized bike) accidents - resulting in 4 fatalities

When mopeds or scooters hit larger motor vehicles, serious injuries are almost guaranteed, along with damage to the driver's moped or scooter. As a trusted scooter and moped accident attorney in Gastonia, NC, Carl Nagle and his team have been representing persons injured on Gastonia's roads for more than 20 years. In fact, our scooter accident lawyers have helped clients recover millions of dollars for their injuries.

Nagle And Associates: Our Sole Focus is Auto Accidents in Gastonia

You don't need to graduate from a prestigious college like Highland School of Technology near Gastonia to know that moped and scooter accidents can be more dangerous and complicated than "normal" car crashes. Those who ride scooters or mopeds have less protection when a collision occurs, and these accidents often involve more significant injuries. With large dollar amounts at stake, insurance companies assign these cases to their best adjusters, and they always seek to blame the scooter rider and minimize what they pay for medical bills and other losses.

At Nagle & Associates, our moped and scooter accident lawyers have helped NC crash victims recover compensation for a range of needs, like past and future medical care costs, replacement of lost wages and tax free compensation for pain and suffering. Some of the most common injuries that take place in scooter and moped accidents include:

  • Traumatic Brain Injuries
  • Facial Fractures
  • Broken Bones
  • Concussions
  • Back Injuries
  • Skull Fractures
  • Much More

Regardless of why you were driving your moped or scooter, if you were injured by someone else's negligence, you deserve compensation. That's where a moped and scooter accident attorney can truly help.

The Role of a Moped and Scooter Accident Attorney in Gastonia, NC

You can think of your moped/scooter accident attorney as your case manager. We begin working immediately, with no up front fees or costs. Our fee is paid only if and when we collect money for you. However, we start working today to contact insurance companies, report your claims, assist with property damage claims, investigate the collision, collect and preserve critical evidence, assist with health insurance filings, collect your medical records, build the strongest and most valuable medical case, and push for the highest possible settlement payments on your behalf. When more than one driver or party is at fault, we bring all at-fault parties and insurance carriers to the table. Simply put, we handle everything for you. You work with doctors to restore your health, and we'll handle everything else.

By communicating with insurance companies, other lawyers, healthcare providers, and anyone else involved, your scooter accident attorney ensures that your rights are safeguarded and your interests are well-represented. That's especially important if you're injured, trying to recover, and worrying about how you'll pay your bills. In such uncertain circumstances, having a compassionate lawyer by your side can be priceless.

The Nagle And Associates Difference

When you're craving a hearty breakfast and want farm-fresh eggs and high-quality sausage, you don't go to a fast-food restaurant and expect to be impressed. You go to Lotus Bar Eatery near Gastonia. Similarly, when you need an experienced, motivated, and accomplished scooter and moped accident lawyer, you don't settle for an average lawyer. You choose Nagle & Associates.

Nagle & Associates differentiates itself from other law firms that deal with moped and scooter accidents, and this separation is deliberate. You won't find our advertisements on the radio, nor will you see promotional ads for our firm on television or billboards. Also, we are Gastonia's ONLY pure motor vehicle accident law firm. We only handle injury claims arising from NC car, truck, motorcycle, pedestrian and scooter accidents. We also offer a lower legal fee than other NC injury lawyers. Our firm charges 25% of settlement, where others charge 33.3%. This leaves more money in your hands when we deliver your settlement.

Some of the accidents we handle have involved:

1. Scooter and moped riders who are hurt and injured by careless drivers

2. Innocent passengers who are injured while riding on the back of a scooter

3. Moped riders who are struck by large trucks who turn directly into their lane

4. Motor-scooter or moped riders struck and injured by drunk drivers

5. Scooter or moped riders who are injured by careless Uber or Lyft drivers

Reduced Fee Structure for Moped and Scooter Accident Victims

Our scooter and moped accident attorneys in Gastonia, NC, work on a contingency fee basis, meaning we only receive payment once your case is settled or the trial concludes. Most cases are settled without the need for lawsuits or court involvement. This fee structure encourages your attorney to seek the maximum value for your injury claims. Whether your case ends in a settlement or proceeds to trial, you can expect to pay a lower overall fee with us.

While most personal injury law firms charge one-third of the settlement (33.3%) and 40-44% of any funds recovered after a lawsuit is started, our firm charges only 25% of the settlement and one-third (33.3%) of any amount collected after filing a lawsuit. We only file suit and pursue litigation when the insurer denies fair compensation, as we recognize that legal action can often lead to a greater financial recovery for our clients.

Rare Experience and Aggressive Advocacy

Nagle & Associates stands out from other scooter and moped accident law firms due to our extensive experience. Founding attorney Carl Nagle is a former insurance adjuster who worked in Atlanta on car, motorcycle, and truck accident claims. He understands the tactics insurance companies use to minimize valid claims and reduce payouts.

After graduating from law school, Carl represented various insurers as an insurance defense attorney. This unique background allows him to effectively challenge and oppose insurance companies that will make every effort to minimize your claims. Now based in Gastonia, he has dedicated his career to helping those affected by roadway collisions, focusing exclusively on representing crash victims throughout our state. When you're injured due to someone else's negligence, and you're recovering in a facility like Morningside of Gastonia near Gastonia, having a team like Nagle & Associates by your side can be priceless.

Moped and Scooter Accidents in Gastonia

Scooter and moped crashes in Gastonia are becoming increasingly common. Companies are renting electric scooters in popular tourist spots like Charlotte, Durham, Cary, and Chapel Hill, allowing customers to explore the city. However, many users lack experience with these vehicles and may be less cautious while on vacation, putting themselves in danger of accidents. Even responsible riders can be struck by inattentive drivers, leading to serious injuries.

Residents are also turning to mopeds, motor scooters, motorized scooters and electric bicycles for commuting due to rising gas prices. Many scooters and mopeds are affordable, costing less than a couple grand while getting up to 150 miles per gallon. However, their small size offers little protection, making riders vulnerable to severe crash injuries. As traffic increases, so does the risk of accidents that involve distracted or negligent drivers. Unsurprisingly, electric scooters and moped drivers are often more at risk than motorcycle riders because they are smaller and slower.

Understanding Moped and Scooter Laws in Gastonia

In Gastonia, individuals are not required to obtain a special license, endorsement, or insurance to operate a motorized scooter or moped. To qualify as a scooter or moped, the two-wheeled vehicle must not exceed 30 mph on a flat surface and must have an engine no larger than 50 cubic centimeters. While these scooters can typically reach relatively high speeds, they can often be difficult to spot on the road. If you find yourself injured while using a motor scooter, it's vital that you speak with an experienced scooter accident attorney in Gastonia, NC. It's very common for insurance companies to claim that you were partially at fault for the incident. Unfortunately, in Gastonia, if you are just slightly at fault for causing your accident (even just 1% at fault), you have no claims and no right of compensation. Considering this harsh law, having an advocate to speak on your behalf and protect your legal rights can be hugely beneficial.

Determining Negligence in Gastonia Scooter and Moped Accidents

If you've been injured in a scooter or moped accident, it's essential to establish that the other party was at fault in order to seek compensation for your injuries. Proving liability is necessary whether you're looking to secure an insurance settlement or pursue a personal injury lawsuit. However, determining fault can be more complicated in e-scooter incidents compared to other types of motor vehicle accidents.

For instance, if a scooter rider hits a pedestrian, it might be straightforward to argue that the scooter driver is liable, particularly if the scooter was on the sidewalk and the pedestrian was walking predictably. Conversely, if an electric scooter rider is struck by a motor vehicle on the street, proving the driver's liability can be more challenging, especially depending on how and where the scooter is being operated.

Cities in Gastonia, like Charlotte, have passed regulations on how electric scooter riders should operate. When scooter riders disregard these safety rules and cause an accident, it can make it easier for victims to demonstrate that the rider is at fault. In some cases, victims might even have grounds to file a claim against the scooter rental company if the company failed to maintain its scooters properly, leading to a malfunction and resulting in an accident.

For example, if a lack of maintenance from the scooter company directly contributed to a malfunction that caused an injury, the victim could pursue compensation from that company. However, many electric scooter companies include clauses in their user agreements requiring riders to agree to arbitration in the event of an injury, which means riders forfeit their right to take legal action in State Court in exchange for the ability to use the scooter.

Not all claims based on these grounds will hold up legally, so it's wise to consult with a scooter or moped accident attorney in Gastonia, NC, if you've been injured in an accident. You may be eligible for compensation for various aspects, including your past and future medical expenses, lost wages, property damage, pain and suffering, and more.

Top 3 Safety Tips for Scooter and Moped Riders in Gastonia

If you drive a moped or scooter frequently, you're probably keenly aware that there are hazards involved. Those include inherent hazards - like driving a vehicle with smaller tires and no roof - as well as others you have little control over. It goes without saying, then, that scooter and moped riders have to be extra careful when driving. At Nagle & Associates, we appreciate the joy of riding on a moped, scooter, or motorcycle. If you do, too, keep these safety tips in mind, whether you're a veteran moped rider or a new e-scooter renter.

Buy a Great Helmet

1. Buy a Great Helmet

Always remember to wear a helmet, regardless of how short your trip is or how fast you're riding. At a minimum, you should opt for a CPSC-certified bike helmet, but for higher speeds, you might want something with even more protection.

Always remember to wear a helmet, regardless of how short your trip is or how fast you're riding. At a minimum, you should opt for a CPSC-certified bike helmet, but for higher speeds, you might want something with even more protection.

2. Always Wear Hand and Eye Protection

If you've ridden a scooter in cold weather, you know that gloves are essential. They keep your fingers warm and help protect them in case of a fall or an accident. You don't want to lose the ability to feel your fingers or use the brakes if an emergency is happening, and gloves can help make sure that doesn't happen. Also, remember to protect your eyes. Sunlight and wind can make it difficult to see the road. Eyewear or a face shield can guard against debris and bugs as well. Always wear protective eyewear, like racing goggles or sunglasses, if not wearing a full-face helmet, to ensure clear vision while riding.

Hand and Eye Protection
Pre-Ride-Check

3. Do a Pre-Ride Check Every Time

For shared scooters, ensure there's enough battery charge and that the tires, display, and controls (brake and throttle) are in good condition. If your scooter folds, check that the folding mechanism is secure and that the light works if it's dark.

For your own scooter, verify all those elements along with any added accessories. Understanding your scooter and checking it before riding helps prevent injuries. For scooters that you own, you should check all of the above, along with any accessories you've added, to ensure they are secure. Keep in mind that some scooters have bolts and exposed cables, while others are more streamlined. Knowing your scooter and performing these checks before each ride can help prevent injuries.

Recent openings and closings saw the arrival of a new cafe in downtown Gastonia, the closing of a Belmont restaurant, and word of a new fast food burger joint coming to the bustling East Franklin Boulevard retail strip. Here's a look at restaurants making headlines since January.

Sake Express, Belmont

Sake Express is closing its restaurant in Belmont, but the owners of the business say they hope to reopen soon at a new location.

Linda Nguyen, who co-owns the restaurant with her sister, Lisa Nguyen, said that Belmont Abbey, which owns the property at 675 Park St., decided to lease the property to Chase Bank.

"We fought long and hard for three months. Unfortunately, it was out of our hands," Nguyen said.

The sisters will close the Park Street location, which opened in 2010, on Jan. 24.

Dallas Tavern & Taphouse, Dallas

Sammy’s Pub of Dallas, located at 130 W. Trade St., was recently sold and became Dallas Tavern and Taphouse.

Part owner Megan Lorusso said on a social media post that when she and her husband bought Sammy’s Pub, the restaurant was on a downswing.

Despite the fact that it was losing money, Lorusso said the couple, “fell in love,” with the staff at the time and wanted to save the restaurant.

“We made the decision not to close the restaurant, make all the changes, then re-open for a few reasons, but the primary one is that we don’t want 38 people out of work before the holidays,” Lorusso said in the December comment. “So, this group has continued to keep business going while simultaneously adapting to our (much different) way of doing things…”

The new menu at Dallas Tavern and Taphouse features items like pulled pork macaroni and cheese, burgers, wings, sandwiches, salad and craft beer on tap, according to the website.

Elena’s Argentinian Café, Gastonia

Elena’s Argentinian Café is now open in Gastonia, bringing Argentinian food and pastries to the city’s downtown.

The café sells Argentinian pizzas, sandwiches, empanadas, cakes by the slice or whole, coffee with beans from Javesca Coffee Roasters, and a variety of pastries.

Paz said her favorite menu item is alfajores, because it is “one of the most Argentinian,” desserts someone could get.

Whataburger, Gastonia

Gastonia is one of a handful of North Carolina cities to see a popular fast food restaurant on the horizon.

Whataburger will open in late spring on East Franklin Boulevard where Backyard Burgers once stood.

Villa Roma, Gastonia

Villa Roma, a family-owned Italian and pizza restaurant in Gastonia, is permanently closing after the most recent operator, Dennis Fascella Jr., died in January at 57.

Family members said they believe Fascella's commitment to the community and way with people are two of the main reasons customers kept coming back to the restaurant over the years.

The Fascella family relocated to Gastonia in the '70s when Dennis Fascella Sr. personally built much of the building that housed Villa Roma and opened the restaurant with Angelo Fascella at 5000 Union Road.

The Bottle Tree, Belmont

The Bottle Tree in Belmont is closing its doors after about five years in business on Davis Street.

After a brief closure, the restaurant will reopen with a new name, menu and theme, according to owner Gabe Sawhney and General Manager Taylor Daniel.

"It was time to do something different and think about what the next step in the future of our organization looked like," Sawhney said. "We decided to close The Bottle Tree and reopen as Kaya Gastrolounge."

The task will be different this season as the Sycamores lost 32 players from last year's team, including 2024 MLB Draftees Randal Diaz (5th Round, Washington Nationals) and Luke Hayden (8th Round, Cincinnati Reds), as well as free agent signee Grant Magill (Chicago White Sox). Overall, seven players from last year's team went on to sign professional contracts following the conclusion of the Sycamores' season in the NCAA Lexington Regional Championship game.

With the departure of 32 players, new faces will abound on the Indiana State roster as the Sycamores welcomed 22 players courtesy of the transfer portal, while nine freshmen made the final 40-man roster announced on Friday morning. Indiana State will have a new lineup across the board with players fighting for position on the field throughout the early few weeks. The early projected lineup features familiar names including Pena and Garis, while Thomas Emerich, Alex Nevils, Weston Fulk, Eli Gipson, Carter Beck, and more will be named Sycamore fans will need to watch over the course of the year.

Scouting Wagner Wagner heads into the 2025 season picked second in the Northeast Conference (NEC) preseason poll as announced by the conference office in early February. The Seahawks posted a 26-30 overall record in 2024 with a 21-12 mark in conference play on their way to advancing to the NEC semifinal round in the postseason.

The Seahawks return leading hitter Xavier Ulrich (.320, 11 2Bs) as the graduate student is expected to be back behind the plate once again this season. Outfielder Lukas Torres (.293, nine 2Bs) and infielder/outfielder Diego Tavarez (.289, six 2Bs) are also back as Wagner returns the services of their top three hitters from the 2025 season. Slugger Mateo Matthews is also back on the roster after posting a team-high seven home runs to go with 33 RBIs in the 2024 season.

Wagner returns one of their three weekend arms from the 2024 season as senior right-hander Connor Hayden is back for the Seahawks. Also returning to the mound include key arms Jake Toporek (16 appearances, 6.55 ERA) and Griffin White (14 appearances, 7.29 ERA) as Wagner will feature a new look on the mound in the coming season.

The Seahawks combined to hit .259 from the plate as a team over the course of the 56-game 2024 season including 22 home runs, 80 doubles, and 11 triples. Wagner's pitching staff compiled a 5.93 team ERA over 489.0 innings with a 401:277 strikeout-to-walk ratio.

Series History Against Wagner, Northeastern Conference This weekend's series marks the first time the Sycamores and the Seahawks will take the field against each other in their respective program histories.

The Sycamores are 1-0 all-time against current Northeastern Conference teams. Indiana State lined up against Maryland Eastern Shore early in the 2012 season at the Bulldog Classic held in Huntsville, Ala. The Sycamores took the 17-2 win over UMES in the win.

Gaston Gazette

Cool Beans Cat Café in Gastonia will soon have both a new owner and a new location, but the business isn't going far.

Gastonia resident Jenny Motes is buying the café from owners Julianna Coon and Sue Ann Propst, and she plans to move from the East Main Avenue space to 176 S. Chester St.

"I've known the owners for years, and they approached me in August just kind of out of the blue," Motes said. "I've always been a cat person since I was little. I've always loved cats. It just sort of made sense to jump on it."

From that point on, Motes said, everything fell into place. She said that after the rent went up at the current location, she began seeking someplace new to open up.

"So really, it took less than 24 hours, and the next property literally fell in my lap," she said.

Someone mentioned property to her that was for rent, and when she went to look at it, she felt it was perfect.

"It was another one of those, 'OK, this is meant to be' kind of moments," she said.

The current space for the cat café was once a law office. The new building is a house.

"They're going to have windows to look out of, and it's going to be a more familiar transition from going from our shop to their forever home," she said.

Motes, a stay-at-home mom of five children, has never owned a business before, but she has worked in a coffee shop, and she loved it.

"One of my first jobs as a teenager was at a coffee shop, and I loved it. I absolutely loved it. That was my favorite job I've ever had," she said.

She aims to reopen the shop in March, and she plans to expand the menu.

"We'll still have the coffee. We're going to be adding more tea. We're going to be adding a lot more drinks," she said.

She said she is putting art on the walls to sell, and she plans to host live music at the shop.

"We're gonna have our parking lot, so plus, we're gonna have the parking across the street where the county buildings are, so there's more options for people to stay for a while," she said. "So I want to have maybe little events, like some acoustic musicians on the porch, maybe on the weekends, or have sort of like a paint and sip deal."

Motes said that she and her husband, Christopher, like to travel, and when they do, they visit small businesses.

"It's basically like I'm taking things from every place I've ever visited," she said.

She said it will be hard not to adopt all the cats at the café.

"But getting to see them go off to what I know will be a nice home makes me happy, because I've been rescuing cats like my whole life, against all of my family members wishes," she said. "So I think my family's a little relieved, because this might tame that bit."

EDITOR'S NOTE: This story was updated because an earlier version included an inaccuracy.

The Crisis Assistance Ministry in Gastonia received 409 applications for rent assistance in January, a record number, according to Executive Director Kim Wheeler.

Now the ministry will be working to fill those needs without previously available funding from the Department of Social Services, which has been out of funds for Rent Assistance since November, according to the county.

Emergency Rental Assistance Program funding was awarded to applicants starting in 2021 to relieve the financial hardship caused by the pandemic, and on Nov. 19, the last of that funding was exhausted, county spokesman Adam Gaub said.

While tax return season has slowed the flow of applications in February, Wheeler said she expects the numbers to increase again throughout the year.

In 2023, Leah Hedgpath, the executive director of Dallas High Shoals Christian Ministry, said she had seen more of her clients go from having homes and vehicles to living on the streets than ever before.

Hedgpath said at the time that the lack of access to rent assistance in the area in combination with other hurdles related to finding affordable housing was contributing to the problem.

This year, CAM has seen large increases in call volume from residents all over Gaston County, Wheeler said. CAM only assists residents of Gastonia and in addition to turning those outside of the city away, the organization has also had to turn people away with rent issues that are simply too large.

The team is currently looking to raise awareness about the rising cost of living and find solutions to continue helping Gastonia residents to the fullest, she said.

According to the North Carolina Housing Coalition's 2025 report, Gastonia is one of the North Carolina cities with the highest fair market rent rates. HUD defines fair market rent as the cost to rent a moderately priced dwelling unit in a designated market.

The NCHC report listed Gastonia's fair market rent alongside Charlotte and Concord at $1,824 per month.

Out of the 409 applications for rent assistance submitted to CAM in January, 60 were from people who had never applied before, which Wheeler said is indicative of the state of rent prices and overall economic struggles in the area.

Wheeler said CAM continues to partner with other groups in the area to find assistance for those living outside of Gastonia, but the options are limited and could become scarce moving further into the year with less available funding.
