Greensboro: Catastrophic Injury Lawyer

Our Fee is 25% of Settlement

Greensboro Catastrophic Injury Lawyer

When injuries are severe, insurance adjusters act fast to cut off their financial responsibility.  The first (and typically unfair) settlement offer sometimes arrives while the accident victim is still in a hospital bed. It may look like a lot of money to someone who is injured and suddenly out of work.  However, early offers are designed to end the victim’s legal case for less than the injury claim is truly worth.

Accident victims with serious injuries should always seek legal guidance as soon as possible.  A legal consultation should be free and no-pressure, and will help you understand all of your legal rights and options.  Former adjuster Carl Nagle warns all crash victims – Claims adjusters are paid cost-control experts, and their only goal is to minimize what the insurance company pays out after a catastrophic accident.  They also are not required to tell you the truth!

Nagle & Associates, P.A. handles catastrophic crash injuries in Greensboro, and we have the legal experience and medical knowledge that enables us to secure maximum compensation in these complicated cases.

Don’t Settle Until Somebody Knows The True Costs

A personal injury settlement is final. Once the Release iss signed, the at-fault driver and all responsible insurance companies are off the hook, no matter how bad your injuries are or what your losses will be over the remainder of your life.

Catastrophic injuries often reveal themselves slowly. A spinal cord injury that reads as incomplete at week three can look very different by month eight, and a brain injury often surfaces in neuropsychological testing that nobody ordered until the family pushed for it. Hardware fails and has to be revised. Chronic pain tends to arrive late, well after everyone assumed the worst was behind them.

We know how these injuries and medical conditions evolve, and we make sure the medical picture is fully developed before we place a price on your case.  We know how to collect for every element of damages, including money for future medical needs when injuries are lasting or permanent.  Insurance companies want to rush these cases and dislike our patient, thorough case development, which is a reasonable indication it’s the right approach.

What Makes an Injury Catastrophic

A catastrophic injury is one a person doesn’t recover from. It permanently limits the ability to work, to live independently, or to manage an ordinary day. In our firm’s experience these injuries include:

  • Traumatic brain injury
  • Spinal cord injury and paralysis
  • Amputation
  • Severe burns
  • Multiple fractures requiring surgical repair
  • Serious internal organ damage
  • Permanent scarring or disfigurement

These severe injuries come out of car, truck, and motorcycle wrecks, which is the only kind of case this firm takes on. Nagle & Associates turns away every other type of personal injury matter. When an injury proves fatal after a period of treatment, the claim becomes a wrongful death case instead, and the suit-filing deadline shortens to two years.  These critical deadlines are our problem, not yours.

Pricing Out the Next Forty Years

A broken wrist that heals by spring gives rise to a case that can be priced now, based on experience with similar cases and jury verdict research.  A C-6 vertebral/spinal injury in a thirty-four-year-old is a different case-valuation exercise entirely.

North Carolina lets a catastrophically injured person collect payment for all future medical care, as long as the claim is fully supported by admissible medical evidence. Proving that number requires evidence from physicians, certified life care planners and economists.  Treating physicians may tell us what the client will need, but in some cases we retain forensic medical experts to lay out the future medical picture. A life care planner prices the future medical needs: attendant in-home care, medical equipment and replacements, prosthetics, home modification, therapy, medications, and the surgeries that are coming whether anyone has scheduled them or not. An economist projects lost earning capacity and lost work life expectancy across a working lifetime that just ended early.  In these cases, we often also employ vocational rehabilitation experts who can explain why the victim cannot return to their job, and why other jobs may not be appropriate due to injuries.

Beyond these losses, the accident victim can also seek tax-free payment for pain, suffering, permanency of injury, scarring, disfigurement, and lost quality of life. This category of damages is usually the largest component of a catastrophic settlement, and it’s the one insurance companies work hardest to compress.

Carl Nagle is a former insurance claims adjuster and former insurance defense attorney. He knows what an insurance carrier does with a life care plan when it lands on the desk, because he used to be the person it landed on.  He also knows how to motivate the handling adjuster to recognize the full extent of a crash victim’s injuries and losses.  If they see us ready and willing to win what we are seeking through a jury trial, they will ultimately pay that amount.  If not, we bring the case to trial and they will then pay you PLUS they then also have to pay you 8% interest on what we win PLUS pay for lawyers to defend and lose the case PLUS pay their own court costs and litigation expenses.  Also, if the jury grants us a higher verdict than what we agreed to settle for, we keep that as well.  As the innocent victim, you have the legal and financial leverage.  Our firm knows how to apply it.

Whether the Money Is Actually There

A verdict is a piece of paper. Collecting it requires insurance coverage or wealth for the at-fault driver.  We know how to locate and access every funding sources, and many money sources are hidden unless you know where to look.

Catastrophic claims routinely exceed the at-fault driver’s policy limits, and the difference has to come from another money source. Additional liability insurance for the driver.  Umbrella policies. An employer’s commercial coverage, if the driver was working. Excess liability layers. Your own underinsured motorist coverage, plus additional UIM coverage held by relatives by blood or marriage who lived at your address on the date of the wreck. In a commercial vehicle case, several insurance coverage layers may sit above the primary policy.

Carl’s background in coverage analysis is how this firm locates the layers of insurance coverage nobody volunteers. Missing one is the difference between a settlement that funds a lifetime of losses and one that runs out far too soon.

One Percent Fault, and Everything Is Gone

North Carolina still follows the law of pure contributory negligence. A finding that the injured person was 1% at fault bars recovery completely, no matter how catastrophic the injury.

The stakes in more serious injury cases make carriers aggressive about this. With a seven-figure financial exposure, a claims adjuster will look very hard for evidence that the victim was slightly at fault, and the injured person often can’t remember the wreck well enough to contradict anything. Families sometimes end up as the only source, and they say things to adjusters that sound harmless and aren’t.

Don’t give a recorded statement. That applies to the client and to everyone in the household.

Injury lawsuits generally have to be filed within three years. Waiting until the medical picture settles is the right call clinically and the wrong one legally if nobody is watching the calendar.

Where Catastrophic Crashes Happen in Greensboro

Two high-speed, high-volume interstates meet near downtown. The Urban Loop added high-speed merges around the perimeter, and I-73 and Bryan Boulevard move traffic fast toward the airport. The more severe wrecks cluster where speed and volume overlap: the I-40 and I-85 corridor, US 220 and Battleground north of the city, and the faster stretches of the Loop.

Rural Guilford County has its own high risk roadways. A lane departure at 55 on a two-lane state highway ends differently than the same mistake in slower-moving inner-city traffic.

Badly injured people in this area go to Cone Health’s Moses H. Cone Memorial Hospital, with the most critical patients sometimes transferred out to nearby Level 1 Trauma Centers.

What the Family Should Be Doing

The client is in no position to manage a legal claim, so this falls to whoever is standing by the victim’s side.

Those with severe injuries should be patient patients, and follow every treatment recommendation, including the ones that take years. Don’t miss appointments.  Gaps in treatment are relied on by adjusters to reduce case offers. Keep track of what this is costing in ways that don’t show up on a medical bill: the job somebody left, the mileage, the ramp installed or other home modifications, the shower chair. Say nothing to any insurance company. And get a lawyer involved early so all evidence is preserved even though the case may not settle for a long while.

Our team of experienced professionals handles every aspect of your case. Two retired North Carolina State Troopers and three licensed North Carolina claims adjusters are on staff here, so crash investigation and case development are handled directly by our team.  Our paralegals have decades of medical experience, so we know how to interpret medical records and diagnostic reports, and how to build and highlight the most valuable medical evidence for our clients.  Our lawyers and on-staff adjusters also know what a case is truly worth, and how to apply legal and financial leverage to make the other side pay full value for a catastrophic injury claim.  Our insurance experience also allows us to locate and access every money source available to fund your losses.  And this is all done for you.  You work with doctors to recover your health, we take care of everything else.

The Fee on a Case This Size

Our firm’s contingency fee is 25% of settlement, compared with the 33.3% most personal injury firms charge. This is a big difference in a serious injury case.  For a $1,000,000 settlement, our reduced fee leaves $83,300 in additional tax-free money in our client’s hands.

Our firm was built to handle serious injury claims and complex roadway crash cases.  There is no fee unless and until we collect money for you, and if we don’t win, there is not fee.  Also, most cases settle, with no lawsuit filings and no court involvement.  However, if the adjuster refuses to pay fairly, we stand ready to conduct your jury trial in your home county.  Our legal fee for litigated cases is 33%, far less than the 40-44% that other firms charge for trials. him.

Results and Client Reviews

Individual settlements at this firm have ranged from the hundreds of thousands to well over $10 million. Over roughly 30 years, the firm has recovered more than $850 million for North Carolina car, truck, motorcycle, and roadway crash victims. Carl Nagle is a member of the Multi-Million Dollar Advocates Forum, an honor only available to lawyers who have resolved injury cases for $2 million or more.

Families in these cases often provide similar feedback when their cases are resolved by our firm. Nobody pressured them to take the early number, we know how to find coverage and secure full payment, and we left no stone unturned.

Frequently Asked Questions

The insurance company already offered us money. Should we take it?

Have somebody look at the offer first, at no cost. Early offers in catastrophic cases are made before anyone has priced future care, and accepting an early offer closes the claim permanently.

Who decides what future medical care is worth?

Treating physicians and other medical experts establish what the future medical needs will be. A life care planner assigns costs to it across the client’s life expectancy. A vocational rehab expert and an economist handle the value of lost future earnings. We retain these experts and build evidence to prove every aspect of a severe injury legal case.

Can you come to the hospital?

Yes. There’s no charge for a home or hospital visit anywhere in North Carolina, and no fee or cost up front to get started.  With just a signature, we can start working for you today.
