Uber’s insurance coverage for their North Carolina drivers works in tiers, with different levels of insurance coverage for each tier.  The coverage tier depends entirely on what the Uber driver was doing when the accident occurred.

App off. The driver was off the clock. Uber’s insurance owes nothing and the driver’s personal auto policy is the only coverage in play. This is the insurance policy identified under the Uber driver’s vehicle description on your police report.

App on, no ride accepted. The driver was logged in and waiting to find a ride opportunity. Here the driver’s policy falls away, and Uber provides contingent liability coverage of $50,000 per person and $100,000 per accident for bodily injury, plus $50,000 in property damage. Those numbers track North Carolina’s required minimum auto insurance coverages.

Ride accepted, or passenger aboard. Once the driver is actively pursuing a ride, Uber’s $1,000,000 liability policy applies, along with uninsured and underinsured motorist coverage that protects passengers when the Uber driver wasn’t the one at fault.

The gap between the middle tier and the top one is $950,000.   Never trust the insurance adjuster to get this right – we always demand the Uber trip records directly from Uber.

Who pays for my injuries after an Uber crash?

It depends on who caused the accident and, if more than one driver caused it, all at-fault drivers owe.  If the Uber driver caused the accident, who pays depends on what the driver was doing in the Uber app. With a ride accepted or a passenger in the car, Uber’s $1,000,000 policy applies. If the Uber driver was logged in and waiting for a ride opportunity, Uber’s coverage pays up to $50,000 per-person for injury claims.  If the Uber App was off, Uber is not involved so the driver’s personal auto policy pays your claims. Uber’s internal driver trip records establish which source pays the victim’s claims.

Do I have to sue Uber?

Usually not. Uber classifies their drivers as independent contractors, and despite challenges this courts have upheld this distinction.  Thus, Uber does not owe, although their insurance policy does still cover and pay claims when an Uber driver causes a crash.  Also, most personal injury cases, even those with attorneys involved, settle privately, with no lawsuit filings and no court involvement.
