Coverage Depends on the Driver’s App Status
Rideshare coverage works in tiers. When the driver is offline and not working, only their personal auto policy applies. Police often fail to ask whether a driver was working, so the driver’s personal policy is typically the only one listed on the police report, and that policy often will not apply. When the app is on but no ride has been accepted, Uber’s policy applies and provides coverage of $50,000 for all property damage claims, $50,000 per-person for bodily injury claims, and $100,000 per-accident to cover the injury claims of all crash victims. Once a ride is accepted and the driver is en route to a passenger or the passenger is in the car, Uber’s commercial liability policy of up to $1 million applies, along with uninsured and underinsured motorist coverage for all policies that separately cover the crash victim. Establishing which tier applies is one of the first things we do, and it can vastly increase the value of the injury claim.

I was a passenger in the Uber. Who do I file against?
Potentially several parties, depending on who caused the crash. If the Uber driver was at fault during an accepted trip, Uber’s $1 million liability policy generally applies. If another driver caused it, their policy applies first, with rideshare uninsured and underinsured coverage available (UIM) if that policy is inadequate. You can collect additional UIM benefits from your household family policies as well.
Does Uber's insurance really cover $1 million?
Yes, Uber’s commercial liability policy of up to $1 million generally applies once a ride has been accepted and during the trip itself. Whether that full limit is available in your case depends on the facts, the injuries, and how the claim is presented.
What if the Uber driver had the app off?
Then your claims will be handled under the driver’s personal auto policy, which often carries much lower limits. This is one of the situations where identifying additional coverage layers matters most.
What if I was partly at fault?
North Carolina’s contributory negligence rule can bar recovery entirely if you are found even 1% at fault. Passengers are rarely exposed to this, but other drivers involved in a rideshare crash frequently are, and insurers will look for it.
