Small Claims Court

Small claims actions are typically brought by private citizens who have no legal representation. While this is a useful forum for small claims, the party who loses in a magistrate action is entitled to appeal and a trial de novo. This is a new trial, which occurs in district court and allows the losing party to eliminate the small claims court victory. Because of the importance of personal injury matters, injury claims typically should not be filed in the North Carolina small claims system. The jurisdictional limit for a small claims action is $10,000.00. If your case might exceed this value, the magistrate’s award is strictly limited to the $10,000.00 figure.
