The amendment, if approved, would have defined the maximum allowable size of a flagpole height “not to exceed 130 feet at grade” and a maximum flag size of “no more than 3,200 square feet.”

The flag sparked controversy when Camping World put it up back in October as councilmembers say is nearly the size of a basketball court at 3,200 square feet and violates city code.

The flag has been flying on a pole that stands 130 feet, almost double the size of the current regulations.

Councilmembers voiced their opposition to the amendment voicing that it isn’t about patriotism but what is permissible under the law.

Matthew Scully read emails from constituents and voiced his opposition.

“To my fellow citizens, I believe we need to do what it right,” he said. “We need to uphold our laws and demand that every citizen and business follow the law, and when laws need to be changed we have a democratic process that allows for that change. Camping World broke the law. It’s not about patriotism, it’s about using our sacred flag to create controversy and division to gain more exposure and ultimately to make more money. I believe this is true because they’ve done this all over the country. If they had followed the law and applied for appropriate text amendment for construction we probably would’ve passed it.”

Marion Blackburn said “When someone breaks the law do we throw up our hands and say ‘oh well I guess we have to change the law for them?’ If they wrap themselves up in a flag when they break the law does that make it ok?”

Last month Greenville’s Planning & Zoning Commission voted 5-4 to deny the approval of the text amendment.

Mayor P.J. Connelly shared a different message from his colleagues during and after the meeting voicing that Greenville should move on.

“I think that the city council in my personal decision made the wrong decision tonight,” he said. “I felt like it was ok to be able to the fly the flag and come up with a text amendment that would allow them to do it. Still make them pay the fines because I think it’s important that you fill out the wrong permit you do have to pay those fines. But I felt like it’s important for us to move on as a community we spend a tremendous amount of time talking about this and I don’t think it’s a good use of our time as a city.”

The city started fining the business in January because the flag is nearly 15 times bigger than the largest flag currently allowed on non-residential property.

The city says Camping World has been cited a total of $8,900. Camping World has only paid $650, which covers the first 4 citations.

During the public hearing, no one spoke in favor of the applicant Camping World, but multiple people spoke against the ordinance.

With the vote, Camping World’s flag still violates the City of Greenville’s current pole and flag size and exceeds the size originally applied for in their permit.

With the flag amendment voted against, there is now the possibility of discussion for future legal action and litigation.

GREENVILLE, N.C. (WBTV) - A fight was brewing Tuesday over an American flag flying at a business in North Carolina -- a situation familiar to some in the Charlotte region.

On Tuesday, Jan. 28, the city of Greenville, North Carolina was embroiled in a battle with Camping World over an American flag they say is simply too big. The city was even issuing fines to the company until it took the flag down.

Business owners, however, were not relenting, and said the flag will stay where it is.

The flag is 15 times the size it’s supposed to be, measuring around 3,200 square feet. But, regardless, the flag went up anyway.

“Camping World, they broke the law,” said a speaker at a recent city council meeting in Greenville.

“It’s not about the red, white and blue. It’s about the black and white of the ordinance that they broke,” the speaker said.

The owners of Camping World are known to push the boundaries. In this case, though, business owners say their message has gotten lost in the chaos.

“I think it’s getting a little misconstrued on what our intent was,” said General Manager John Foskey.

The flag is about patriotism, Foskey said, not about causing waves.

“I’m ready to go toe-to-toe with anyone who wants to question integrity,” said Camping World owner Marcus Lemonis.

While challenges and fines are whipping in the wind, many people are reminded of the exact same controversy that happened in Iredell County.

Just a few years ago, the Camping World in Statesville, North Carolina faced legal challenges from the city about their oversized flag. A line was drawn in the sand with neither side showing signs of giving in.

“How has this impaired the health wellness and safety of somebody? In the absence of that, changing this flag is not an option,” Lemonis said.

After months of fines and challenges, the city finally relented, and the 80-foot American Flag remained right where it was in Statesville. But this isn’t the first time city leaders tried to have a symbol removed from a business.

At Floyd’s Downtown Barbershop in Statesville, the problem wasn’t a flag, but rather a barber pole -- an easily recognized symbol of the trade.

Owner Tim Head told WBTV that when he first opened, the city tried to have it removed because it rotated, possibly causing a distraction.

“So I ended up having a little hearing with the zoning board and the city council,” Head said.

Head was eventually grandfathered in, and the issue resolved itself.

While locally the problems with Camping World have been hashed out, the fight in Greenville is far from over.

“It’s the symbol of freedom in our country. No matter what generation you’re in, young or old people love it,” Foskey said.

The owners of Camping World are hoping what happened in Statesville will also in Greenville, allowing them to keep flying their massive flag.

“The directive right now is to keep the flag flying,” Foskey said.
